Limits of liability
Abeking & Rasmussen ROTEC GmbH & Co. KG (A&R ROTEC) is as provider of content responsible for the content the company itself provides for use, in accordance with general legislation. Links referring to the content of other providers are to be distinguished from the company’s own content. Using links, A&R ROTEC is providing "external content" for use, marked in the following way: link name. A&R ROTEC is only liable for such external content if the company is actively aware of the content (including of illegal or criminal content) and is technically and reasonably able to prevent its use (§5 Para. 2 of the German Act on Teleservices - TDG). However, "links" are "live" (dynamic) elements. In placing the link on its website, A&R ROTEC has checked the external content for potentially civil or criminal offences. The content provider is, however, in accordance with the TDG not obliged to continue checking the information that he refers to for modifications which would imply liability. Only if he establishes or is made aware of a civil or criminal offence represented by a concrete content, to which he refers, he will, as far as technically and reasonably possible, remove reference to such content. Technical and reasonable possibility will not be affected by the fact that although A&R ROTEC has removed all links to the content it might still be possible to access the illegal or criminal content from other servers.
